By accessing or using Nomino ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
These Terms are between you and Nomino Ltd ("Nomino", "we", "us").
Nomino is a language learning application that provides:

Nomino is not directed to users under 13. If you are 13–17, a parent or legal guardian must review these Terms and supervise use. We design Nomino with the UK Age-Appropriate Design Code in mind and do not use behavioural advertising targeted at children.
Premium is available Monthly (£8.99) or Yearly (£79.99). Prices include applicable VAT where required.
New subscribers receive a 3-day free trial. At the end of the trial your plan auto-renews at the then-current price unless cancelled at least 24 hours before the trial ends.
If you are a UK/EEA consumer you have 14 days to cancel after purchase. If you start the trial and expressly consent to immediate supply of digital content and acknowledge you will lose the right to cancel on conversion, your cooling-off right ends when the trial converts to a paid plan.
Payments are processed by Apple's App Store. Cancellation must be completed in your Apple ID Subscriptions settings. Refund requests are handled by Apple; statutory rights remain unaffected.
Nothing in these Terms affects your statutory rights. If Nomino is defective (not of satisfactory quality, not as described, or not fit for purpose), you may be entitled to repair, replacement or a price reduction under the Consumer Rights Act 2015. For App Store purchases, request a refund via reportaproblem.apple.com. Contact us if you believe a defect originates in our service.

We may suspend or remove content or accounts to protect users or comply with law.
You retain ownership of prompts, recordings, and messages you submit. You grant Nomino a worldwide, non-exclusive, royalty-free licence to host, process, transcribe, and display your Content to provide and improve the service. We do not sell your personal data.
Subject to third-party rights and applicable law, you may use AI outputs for personal, non-commercial language learning. You are responsible for ensuring outputs do not infringe others' rights or violate law. Do not present outputs as professional advice.
Where you use voice features, you confirm you have the right to use any voices you upload and will not attempt to clone voices without permission.
All content, features, UI/UX, and functionality of Nomino are owned by us and protected by copyright, trademark, and other intellectual property laws. You must not:
We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
We may add, change, or remove features. If a change materially reduces core functionality of your current paid plan, you may cancel and receive a pro-rata refund of any prepaid unused fees obtained via Apple's refund process.
AI conversations and feedback are educational aids and may be inaccurate or incomplete. Do not rely on the service for legal, medical, safety-critical, or emergency communications. Nomino is designed for language learning assistance. We do not guarantee:
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We process your prompts, recordings, and usage data to provide AI-powered language learning features. THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under English law.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:
Our total liability shall not exceed the amount you paid in the past 12 months. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under English law.

We may suspend or terminate for material breach, unlawful use, or risk to users. You may stop using the service at any time and cancel via Apple.
On termination or cancellation:
We may update these Terms. For material changes, we will give at least 30 days' notice via in-app notice or email. If you do not agree, you may cancel before the effective date. Continued use after the effective date constitutes acceptance.
These Terms are governed by the laws of England and Wales, and courts of England and Wales have exclusive jurisdiction. UK consumers may also bring disputes to local courts.

For users who download the App from the Apple App Store:
We may rate-limit or block access to protect the service from abuse, security threats, or excessive automated usage. We reserve the right to implement technical measures to prevent circumvention of usage limits.
You must not use the service in violation of UK, EU, or US export control or sanctions laws. You must not access or use the service if you are located in, or ordinarily resident in, an embargoed country or territory, or if you are on any sanctions list.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nomino regarding use of the App.
